Example question: Bloomberg reported that supply constraints are leading to iPhone shortages. Do Trefis analysts see a meaningful impact on AAPL?
Example comment: Competition will squeeze AMZN's operating margins from 4% to 2% meaning a 10% hit to the stock according to Trefis.

  • Whistleblower case is public:

Bryan Rose a former employee of Intuitive has spilled the beans. I have found out today, Intuitive requires that a physician have at least 3 surgeries scheduled in advance before they will even train a doctor in robotic surgery. This means these physicians are scheduling surgeries without fully understanding the usage of robotics. It also means the physicians will not properly explain the benefits or possible detriments to the patient.

ISI conditions training on the number of surgeries scheduled utilizing the DaVinci before training is approved this results in profits for ISI before a physician is even qualified in the technology.

This scheme has interfered with the doctor patient relationship. It creates a conflict of interest potentially putting a patient at great risk. CSR's (Clinical sales reps) are told to ask for 5 cases booked in advance with a time limit on first cases for all specialties. ISI's demand for scheduled cases in exchange for training constitutes an illegal quid pro quo.

Quid pro quo ("something for something" in Latin) means an exchange of goods or services, where one transfer is contingent upon the other.

ISI has also provided physicians with corporate paid trips, training, and marketing materials as long as they schedule surgeries using the DaVinci.

ISI also promotes surgeons on it's "surgeon's list" on the company webiste as long as they complete 20 surgeries utilizing the DaVinci. The surgeon has to maintain this promotional benefit by continuing to complete a minimum of 20 surgeries per year. This constitutes an unlawful inducement.

There is no difficulty or standard set for different types of cases completed other than completed procedures. Sales volume driving surgery decisions are at the expense of proper medical decision making and patient care.

There is also proof of utilization of ISI equipment for gynecological procedures which were not approved by the FDA at that time. CSR's leveraging physicians by fraudulently planning "Market Development Events" with no intention of holding these events. The fraudulent sales pitch is used to deceive hospitals that do not own ISI products or physicians not trained with ISI products to believe they are missing out on significant surgical income.

ISI has even orchestrated fraudulent billing by providing coding procedures which ultimately caused fraudulent medicare and medicaid billing.
